Nwodo"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">In the midst of the buzz, bustle and hyperactivity that accompanies Abuja\u2019s real estate market, it is quite easy for crucial subtleties to be overlooked by players in an industry that often prioritizes today\u2019s profit over tomorrow\u2019s certainty, numbers over details and swiftness over due process. This pattern has in several instances occasioned severe financial losses, anguish and regret for hapless buyers caught up in the frenzy of the ever-buzzing market. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is therefore not a point of debate that Abuja\u2019s real estate market is deeply afflicted by systemic maladies, including the fraudulent disposal of unallocated lands, the illicit sale of government-reserved properties, the distribution of fatally incomplete documentation, and the rampant proliferation of deceptive developers who exploit unsuspecting buyers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As this profiteering and racketeering machine continues to grind unendingly, one of the fundamental documentation flaws that often goes unnoticed or is deliberately shushed is what we refer to as the &#8220;purchase-receipt economy&#8221;. This specifically refers to the practice of paying for property in exchange for mere receipts, customary letters of allocation or other forms of documentation that cannot survive slight statutory scrutiny. This practice is widely adopted to bypass the bureaucratic bottlenecks that delay the processing of ministerial consent that statutorily validates the transfer of property title. This article posits that while the informal &#8220;purchase-receipt economy&#8221; keeps the market moving fast, it operates on a legal fiction that leaves investors highly vulnerable to demolition, double allocation, and financial loss.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The Legal Bedrock: How Land Ownership Actually Works in the FCT<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Land administration in the FCT is primarily governed by a constitutional and statutory legal framework. Constitutionally, Section 297(2) of the 1999 Constitution expressly vests all land in Abuja wholly in the Federal Government. This provision crowns the Federal Government as the \u201cUltimate Landlord\u201d in the Federal capital. By the provision of the FCT Act (SEE Section 18 precisely), the FCT Minister enjoys the power by presidential delegation to administer land in the FCT. Thus, the tenor harmoniously chorused by the Constitution and statute is that the FCT Minister is the sole administrative custodian who can grant a Right of Occupancy (R of O) and sign a Certificate of Occupancy (C of O). Furthermore, Section 22 of the Land Use Act explicitly mandates that any subsequent alienation of this interest\u2014whether by sale, assignment, mortgage, or transfer\u2014requires the prior consent of the Minister. Consequently, a title bereft of ministerial approval cannot be deemed perfect. It is inchoate; in some cases, deficient and malnourished of validity. Without his consent, the transaction is statutorily void.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Anatomy of the &#8220;Purchase-Receipt&#8221; Economy<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reality of land administration in the FCT is however a stark contrast from what the law advances. Systemic bottlenecks, bureaucratic clogs and administrative redtapes stare stakeholders in the eye sternly and rudely disperses them to search for alternative routes to facilitating transactions. The grant of RofO and CofO is widely marred by extreme delays at the Abuja Geographic Information Systems (AGIS), high registration fees and lengthy delays of securing ministerial consent.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet, the buzz of the market will not cease. Sellers, developers, and agents are forced to devise alternatives to keep the clock ticking. As Eneke the bird wisely noted in Chinua Achebe\u2019s Things Fall Apart: &#8220;Since men have learned to shoot without missing, he has learned to fly without perching.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this parallel economy, transactions are driven by speed and informal documentation. A developer acquires a large tract of land, often based on an old customary title or an unregularized Area Council allocation and subdivides it into estate plots. Eager buyers pay millions of naira and walk away with a &#8220;Purchase Receipt,&#8221; a &#8220;Deed of Assignment,&#8221; or an &#8220;Irrevocable Power of Attorney.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Legally speaking, these documents do not convey full, unimpeachable ownership. The Supreme Court of Nigeria has repeatedly affirmed that a Power of Attorney is merely an instrument of delegation; it authorizes an agent to act on behalf of the principal, but it does not transfer radical title to land. Similarly, a purchase receipt is merely evidence of payment, not a document of title.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The Complicated Legacy of Area Council Allocations<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This friction between rigid statutory demands and fluid informal practice finds its deepest, most complicated expression in the history of Area Council allocations.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Long before the centralization of land administration in Abuja became the gospel of the FCT Administration, local Area Councils\u2014such as AMAC, Bwari, and Kuje\u2014actively and legally carved up and allocated land. They were the primary custodians of the soil, issuing titles that investors relied upon with absolute confidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, few years ago, the landscape was radically altered and this regime became relegated to antiquity. Area Councils as per ministerial directives were effectively stripped of their land allocation powers, and the entire process was centralized under the Minister\u2019s office and AGIS database.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This sudden regulatory pivot created a massive historical disconnect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Today, this disconnect manifests as a ticking financial time bomb. Millions of naira change hands daily as thousands of properties are aggressively bought and sold on the strength of these legacy Area Council papers or entirely unapproved local layouts. The market, in its relentless drive to keep moving, treats these documents as valid legal currency. Sellers trade them with bravado, and buyers accept them out of desperation or ignorance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V. <strong>The Harsh Practical Realities (What&#8217;s at Stake?)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The sniffing dangers of this debacle is significant. The propensity for fraud in land transactions is heightened in this circumstance. Because these informal transactions are not registered in the central database at AGIS, the same plot of land can be sold to multiple buyers, leading to ownership uncertainty, wrangling and endless litigation with the attendant waste of time and financial resources.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, estates built on these undocumented or poorly titled lands face the constant threat of enforcement actions. When the FCTA moves in with bulldozers to clear illegal structures or unapproved layouts, developers and buyers are left with no legal recourse. Because their transactions violated Section 22 of the Land Use Act from inception, they cannot claim compensation for the loss of their investments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Moreover, this structural informality traps significant capital. Properties within the purchase-receipt economy are essentially dead capital. Because they lack a registered statutory title and the necessary ministerial consent, they cannot be used as collateral to secure bank financing. This restricts the financial growth of property owners and deprives the government of essential revenue from registration fees, stamp duties, and capital gains taxes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The Way Forward<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If Abuja\u2019s property market is to stop building its glittering castles on shifting legal sands, a radical shift in mindset and mechanics is non-negotiable. The current model is unsustainable. To salvage the billions trapped in this parallel economy, stakeholders must abandon the comfort of informal shortcuts and embrace a culture of systemic compliance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">* For Investors and Buyers\u2028The alluring speed of the informal market must be aggressively exchanged for the painstaking discipline of absolute legal scrutiny. Investors must look past the polished marketing brochures and the reassuring promises of agents. A secure transaction demands that you never commit capital without conducting a rigorous independent search. This investigation must extend beyond the digital databases of AGIS; it requires a deep physical site inspection and a meticulous audit of the land\u2019s historical lineage to ensure it is not an overlapping allocation or an encroaching footprint on a green verge.<\/p>\n\n\n\n<div class=\"wp-block-uagb-image uagb-block-2503c124 wp-block-uagb-image--layout-default wp-block-uagb-image--effect-static wp-block-uagb-image--align-none\"><figure class=\"wp-block-uagb-image__figure\"><\/figure><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">* For Developers:\u2028The temptation to quickly carve up unapproved layouts and trade them on raw market momentum must give way to a commitment to long-term value creation. Developers must prioritize obtaining official layout approvals and regularizing titles before the first block is laid or the first plot is sold. A ironclad statutory title is not an administrative burden or an expensive delay; it is the ultimate premium asset that elevates property valuation, attracts institutional funding, and shields your buyers from the traumatic roar of government bulldozers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the FCTA and AGIS:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The administration cannot continue to play the sole role of a stern punisher, waiting with a bulldozer at the end of a broken system. Regulators must meet the market halfway by engineering an accessible, fast-tracked, and financially realistic regularization window. By deliberately lowering the administrative and financial barriers for everyday citizens to convert legacy Area Council papers and informal deeds into recognized statutory titles, the FCTA can seamlessly transition dead capital into the formal economy.
